Article 1: General Provisions
The e-commerce website of Peggy Sew, a sole proprietorship, with registered office at  Mechelsesteenweg 368/202, 3020 Herent, Belgium and VAT registration BE 0558,950,226 (hereinafter “Peggy Sew ‘) offers its customers the ability to buy products from her shop online.

These General Terms and Conditions (“Terms”) are applicable to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the online store of Peggy Sew the Customer must accept these conditions explicitly, to indicate that he agrees to the applicability of these Terms and to the exclusion of all other conditions. Additional conditions from the customer are excluded except when they are explicitly accepted in writing by Peggy Sew before the purchase.

Article 2: Price
All prices are expressed in EURO, always including VAT (when applicable) and all other duties or taxes.

If delivery, reservation or administration fees are charged, this will be indicated separately.

The stated price refers only to the articles as verbally described. The accompanying photos are decorative purposes and may contain elements that are not included in the price.

Article 3: Offer
Despite the fact that the online catalog and e-commerce website are compiled with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer don’t bind Peggy Sew. Peggy Sew is only bound to an obligation of means regarding the accuracy and completeness of the information offered. Peggy Sew is in no way liable in case of obvious clerical errors or printing errors.

Image colors may vary from the colors in reality, amongst others those can be affected by the settings of the clients monitor.

If the customer has specific questions about eg. Size, color, availability, delivery, or delivery method, we ask the customer to contact Peggy Sew in advance.

The offer is valid while stocks last and may at any time be modified or revoked by Peggy Sew. Peggy Sew can not be held responsible for the unavailability of a product. If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.

Article 4: Online Purchases
To order articles, go to the desired section and click on the “order” button. Select the desired number and confirm. Do this for all items you wish to purchase.

To finalize the order, go to the basket and select delivery options as “standard” or “collection” (in Herent). Select the country of delivery and payment method. Then click on “continue to checkout”.

Peggy Sew reserves the right to refuse an order pursuant to a serious failure of the Customer with respect to orders in which Customer is involved

Article 5: Delivery and implementation of the agreement
Once payment from the customer is received by Peggy Sew, goods are normally shipped within 24h-.

Payments by credit card or paypal will be immediately received.
When paying by bank transfer it may take several days before the money arrives in the account of Peggy Sew. If the customer chooses to pay by bank transfer, then this must be done within seven days, otherwise the order will be canceled and the reserved goods are resold.

Products ordered through the webshop are delivered worldwide.

The goods are sent with Bpost, PostNL or an alternative parcel service.

The shipping rates depend on the weight, volume and destination of the parcel. Before you pay, you are always shown the shipping rate applied.

Following minimum rates will apply:

Belgium: € 1.90

NL / LUX: € 4.00

EN / FR / UK: € 4.25

US: € 4.25

Any visible damage and / or qualitative deficiency of an article or other failure in the delivery must be reported immediately by the Customer to Peggy Sew.

The risk for loss or damage is transferred to the customer as he (or a third party designated by him, which is not the carrier) has received the Goods in physical possession. The risk, however, is all for the customer upon delivery to the carrier if the carrier of the Customer has been commissioned to carry the goods and that choice was not offered by Peggy Sew.

Article 6: Retention of title
The delivered goods remain until the moment of full payment by the Customer, the exclusive property of Peggy Sew.

Article 7: Right of Withdrawal
The provisions of this Article shall apply only to Customers in their capacity as consumers buy products online at Peggy Sew.

The Customer has the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day the Customer or a third party designated by the Customer, other than the carrier acquires, physical possession .;

To exercise the right of withdrawal, the Customer must send to Peggy Sew (Mechelsesteenweg 368/202, 3020 Herent, info@peggysew.com) an unequivocal statement (eg. In writing by post, fax or email) to notify his decision to withdraw.

To comply with the withdrawal period, the Customer must send its notice on its exercise of the right of withdrawal before the withdrawal period has expired.

Customer goods must promptly, but in any event no later than 14 calendar days after the date of his decision to withdraw from the contract is communicated to Peggy Sew,be returned or handed over to Peggy Sew. The Customer is on time if he sends back the goods before the period of 14 calendar days has expired.

The direct cost of returning the goods are borne by the Client.

If the returned product is in any way impaired, Peggy Sew reserves the right to establish the liability of the Customer and claim compensation for any diminished value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary in order to determine the nature, characteristics and operation of the goods.

Only items that are in their original packaging, along with all accessories, instructions and invoice or sales receipt can be returned.

If the customer cancels the contract, Peggy Sew will refund the customer within a maximum of 14 calendar days after Peggy Sew has been informed of the decision by the Customer to the to withdraw from contract. For sales Peggy Sew may withhold the reimbursement until she has received the goods back, or until the customer has demonstrated that he has sent back the goods, whichever is the earliest.

Peggy Sew pay back the customer’s bank account unless otherwise agreed.

The Customer may not exercise the right of withdrawal:

service contracts after the full implementation of the service
delivery according to customer specifications of the goods manufactured or clearly intended for a specific person;
the supply of newspapers, periodicals or magazines
the supply of digital content which is not supplied on a tangible medium, such as crochet and sewing patterns on a digital medium such as a PDF file.
Article 8: Privacy
The controller, Peggy Sew respects the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data.
The personal information provided by you will only be used for the following purposes: processing the order, send newsletters, advertising and / or marketing purposes.

Article 11: Amendments to the conditions
These will be supplemented by other terms which explicitly refers to, and the general conditions of Peggy Sew. In case of contradiction, the present Terms and Conditions.

Article 12: Evidence
The Customer agrees that electronic communications and backups can serve as evidence.

Article 13: Applicable law – Jurisdiction
The Belgian law is applicable with the exception of the rules of private international law concerning applicable law and the Rome I Regulation on the International Sale of Goods.
